FIRST PROSECUTION IN NOTTINGHAM OVER TRAM SPIT INCIDENT Alan Harvey, 26, has become the first person to be prosecuted over spitting at a tram conductor since the introduction of spit kits on Nottingham’s trams and buses. The kits allow analysis to take place on saliva with all 15 trams and 320 NCT buses so equipped. It allows the Police to check the DNA against the national DNA database.
The incident happened on 2nd February 2008 when Mr Harvey refused to pay for his fare and also refused to get off the tram. The conductor had turned his back on him to talk to the driver when the incident happened. The kit was used to take the sample and without it he would not have been convicted. He was sentenced to 30 days in prison after he changed his plea to guilty.
Helen Goulding, NET Manager, said: “We are delighted that the spit kits used to collect DNA evidence have resulted in a successful prosecution, and will use them in the future to prosecute any passenger who behaves in this way. It is not acceptable that our staff should have to tolerate such abuse, and we will continue to adopt a zero tolerance policy to ensure our trams are safe and pleasant mode of transport for all."
